Finley’s conceptualization of Greco-Roman slavery was developing in the late 1930s, between W. L. Westermann’s traditional notions and the revolutionary ideas advanced by his contacts in the Frankfurt School in Exile. Turning points came in 1936, when he reviewed Westermann’s Realencyclopädie article on slavery, and in 1937, when he was hired to assist Otto Kirchheimer in the production of a monograph on penal history and reform. The resulting book, Punishment and Social Structure, became a classic text of modern criminology, but (...) it also shaped Finley’s ideas concerning the nexus of forced labor, punishment, and the demands of a labor economy. Increasingly, commissioners and providers of services for people with intellectual disabilities are turning to assistive technology and telecare as a potential solution to the problem of the increased demand for services, brought about by an expanding population of people with intellectual disabilities in the context of relatively static or diminishing resources. While there are numerous potential benefits of assistive technology and telecare, both for service providers and service users, there are also a number of ethical issues. The aim of this (...) paper is to raise these issues and to set them within the ethical framework proposed by Beauchamp and Childress. Democracy is rule of the people, but this tells us little, and lack of conceptual clarity creates confusion and undermines productive discussion. This paper explores four dimensions of democracy, articulating ways we can think about and apply the concept. The first concerns who we mean by the people, and here a state is more democratic when its body-politic is more inclusive. The other three concern what it means for the people to rule, and pertain to the theoretical principle of democracy, (...) sovereign structures that are democratic, and actual democratic practice within a state. Distinguishing the dimensions is important because states can be more or less democratic along different dimensions. Thinking in terms of the dimensions of democracy enables more precise and productive debate on democratic government. Moreover, it reveals ways that democracy may change and evolve in the 21st century. (shrink)

The founder of modern linguistics, Ferdinand de Saussure inaugurated semiology, structuralism, and deconstruction and made possible the work of Jacques Derrida, Roland Barthes, Michel Foucault, and Jacques Lacan, thus enabling the development of French feminism, gender studies, New Historicism, and postcolonialism. Based on Saussure's lectures, _Course in General Linguistics_ traces the rise and fall of the historical linguistics in which Saussure was trained, the synchronic or structural linguistics with which he replaced it, and the new look of diachronic linguistics that (...) followed this change. Most important, Saussure presents the principles of a new linguistic science that includes the invention of semiology, or the theory of the "signifier," the "signified," and the "sign" that they combine to produce. This is the first critical edition of _Course in General Linguistics_ to appear in English and restores Wade Baskin's original translation of 1959, in which the terms "signifier" and "signified" are introduced into English in this precise way. Baskin renders Saussure clearly and accessibly, allowing readers to experience his shift of the theory of reference from mimesis to performance and his expansion of poetics to include all media, including the life sciences and environmentalism. An introduction situates Saussure within the history of ideas and describes the history of scholarship that made _Course in General Linguistics_ legendary. The subject’s perspective objection (SPO) is an objection against externalist theories of justification, warrant, and knowledge. In this article, I show that externalists can accommodate the SPO while remaining externalist. So, even if the SPO is successful, it does not motivate internalism, and the primary motivation for internalism has been lost. After this, I provide an explanation for why so many people find cases that motivate the SPO convincing.

The diffusion of technology in the US has taken place in an environment of both regulation and free enterprise. Each has been subject to manipulation by doctors and medical administrators that has fostered unprecedented ethical dilemmas and legal challenges. Understanding these developments and historical precedents may allow a more rational diffusion policy for medical technology in the future.

A collection of twelve essays by John Perry and two essays he co-authored, this book deals with various problems related to "self-locating beliefs": the sorts of beliefs one expresses with indexicals and demonstratives, like "I" and "this." Postscripts have been added to a number of the essays discussing criticisms by authors such as Gareth Evans and Robert Stalnaker. Included with such well-known essays as "Frege on Demonstratives," "The Problem of the Essential Indexical," "From Worlds to Situations," and "The Prince (...) and the Phone Booth" are a number of important essays that have been less accessible and that discuss important aspects of Perry's views, referred to as "Critical Referentialism," on the philosophy of language and the philosophy of mind. Words stand for things of various kinds and for various kinds of things. Because words do this, the sentences made up of words mean what they do, and are capable of expressing our thoughts, our beliefs and conjectures, desires and wishes. This simple idea seems right to me, but it flies in the face of formidable authority. In a famous passage in “Reality without Reference,” Donald Davidson criticizes what he calls the “building-block theory:”.

In this essay, I sketch a preliminary account of philosophical curiosity. Drawing on philosophy of curiosity, philosophy of education, and philosophical pedagogy, I argue first that philosophical curiosity is a set of investigative practices and affects that engage philosophical content and philosophical skills. Turning to critical pedagogy and meta-philosophy, especially via Paulo Freire and Kristie Dotson, I then supplement the preliminary account by arguing that philosophical curiosity is also rooted in existential exploration and communal inquiry. I argue for the necessity (...) of this supplement by showing that, in failing to account for what and who philosophical curiosity is for, we risk excluding diverse practitioners and phenomena from the philosophical enterprise. I then evaluate two pedagogical exercises in philosophical curiosity—the Freedom Schools’ citizenship curriculum and Melissa Shew’s Curiosity Project—in light of this account. John Perry offers a rethinking of Frege's seminal contributions to philosophy of language, which had a dominant influence on the subject in the twentieth century. He argues that Frege's famous doctrine of indirect reference led philosophers on a detour, and he advocates a move to a new framework for understanding reference.

Against the backdrop of a longstanding feminist critique that Michel Foucault’s call to anonymity is insensitive to the erasure of marginalized persons, I aim to contribute to a critical account of anonymity as a feminist Foucauldian ideal. I do this in two ways. First, I analyze the tactical role of anonymity in the Prisons Information Group, an organization in which Foucault was involved. Second, I analyze the unique paradoxes of anonymity faced by gender non-conforming prisoners then and now. I conclude (...) that anonymity is ideally a situational and multi-layered tactic. By developing a modality of anonymity accountable to the differential politics involved in the chosen or forced renunciation of a name, I contribute to a critical evaluation of anonymity as a practice of resistance from within and beyond the prison system. Demonstratives seem to have posed a severe difficulty for Frege’s philosophy of language, to which his doctrine of incommunicable senses was a reaction. In “The Thought,” Frege briefly discusses sentences containing such demonstratives as “today,” “here,” and “yesterday,” and then turns to certain questions that he says are raised by the occurrence of “I” in sentences (T, 24-26). He is led to say that, when one thinks about oneself, one grasps thoughts that others cannot grasp, that cannot be communicated. However, (...) nothing could be more out of the spirit of Frege’s account of sense and thought than an incommunicable, private thought. In the first part of the paper, I explain the problem demonstratives pose for Frege, and explore three ways he might have dealt with it. I argue that none of these ways provides Frege with a solution to his problem consistent with his philosophy of language. The first two are plausible as solutions, but contradict his identification of the sense expressed by a sentence with a thought. The third preserves the identification, but is implausible. In the second part, I suggest that Frege was led to his doctrine of incommunicable senses as a result of some appreciation of the difficulties his account of demonstratives faces, for these come quickly to the surface when we think about “I.” I argue that incommunicable senses won’t help. I end by trying to identify the central problem with Frege’s approach, and sketching an alternative. (shrink)

Unmet legal needs contribute to housing, income, and food insecurity, along with other conditions that harm health and drive health inequity. Addressing health injustice requires new tools for the next generations of lawyers, doctors, and other healthcare professionals. An interprofessional group of co-authors argue that law and medical schools and other university partners should develop and cultivate Academic Medical-Legal Partnerships (A-MLPs), which are uniquely positioned to leverage service, education, and research resources, to advance health justice.

Following his recently expanded _The Problem of the Essential Indexical and Other Essays,_ John Perry develops a reflexive-referential' account of indexicals, demonstratives and proper names. On these issues the philosophy of language in the twentieth century was shaped by two competing traditions, descriptivist and referentialist. Oddly, the classic referentialist texts of the 1970s by Kripke, Donnellan, Kaplan and others were seemingly refuted almost a century earlier by co-reference and no-reference problems raised by Russell and Frege. Perry's theory, borrowing (...) ideas from both traditions as well as from Burks and Reichenbach, diagnoses the problems as stemming from a fixation on a certain kind of content, coined referential or fully incremental. Referentialist tradition is portrayed as holding that indexicals contribute content that involves individuals without identifying conditions on them; descriptivist tradition is portrayed as holding that referential content does not explain all of the identifying conditions conveyed by names and indexicals. Perry reveals a coherent and structured family of contents — from reflexive contents that place conditions on their actual utterance to fully incremental contents that place conditions only on the objects of reference — reconciling the legitimate insights of both traditions. G. E. Moore famously noted that saying 'I went to the movies, but I don't believe it' is absurd, while saying 'I went to the movies, but he doesn't believe it' is not in the least absurd. The problem is to explain this fact without supposing that the semantic contribution of 'believes' changes across first-person and third-person uses, and without making the absurdity out to be merely pragmatic. We offer a new solution to the paradox. Our solution is that the (...) truth conditions of any moorean utterance contradict its accuracy conditions. Thus we diagnose a contradiction in how the moorean utterance represents things as being; so we can do justice to the intuition that a Moore-paradoxical utterance is in some way senseless, even if we know what proposition it expresses. This paper proposes that the philosophy of Bernard Lonergan can provide insight into the challenge of integrating nursing theory, research and practice. The author discusses Lonergan's work in regard to reflective understanding, authenticity and the human person as a subject of consciously developing unity. This is followed by a discussion of two key elements in Lonergan's work that relate to nursing: the subject–object challenge of nursing inquiry and common sense vs. scientific knowledge. Bergson identifies multiple forms of memory throughout his work. In Matter and Memory, Bergson considers memory from the perspectives of both psychology and metaphysics, and he describes what we might refer to as contraction memory, perception memory, habit memory, recollection memory, and pure memory. Further, in subsequent works, Bergson discusses at least two additional forms of memory – namely, a memory of the present and a non-intellectual memory of the will. However, it is often not clear how these different forms (...) of memory relate to one another. With the aim of providing an overview of Bergson's philosophy of memory that can also serve as a point of entry to his philosophy as a whole, this article explores the different senses and forms of memory that Bergson describes, paying special attention to how they are distinct from one another and how they are unified. It is my intention to show that, although these various senses and forms of memory are different from one another , they are also continuous and unified insofar as they are equivalent to different tones of one's mental life and to different tensions of one duration. When a caregiver names objects dominating a child’s view, the association between object and name is unambiguous and children are more likely to learn the object’s name. Children also learn to name things other than solid objects, including nonsolid substances like applesauce. However, it is unknown how caregivers structure linguistic and exploratory experiences with nonsolids to support learning. In this exploratory study of caregivers and children we compare caregiver-child free-play with novel solid objects and novel nonsolid substances to identify the (...) linguistic and exploratory experiences associated with children’s word learning. We found systematic differences in interactions with novel objects, such that children performed more manual actions on solids than nonsolids and caregivers named solids more than nonsolids. Additionally, there was less synchrony between caregivers’ naming and children’s manual and visual exploration of nonsolids than solids. Consistent with prior work, we found that synchronous naming was associated with accurate recognition of solid object names. However, naming synchrony was not associated with recognition of nonsolid substance names or with generalization. Together these findings, though exploratory, suggest the coordination of caregiver-child play can shape what children remember about novel word-object associations for solid objects, but not nonsolid substances. Two pediatric accidents in Jane Austen’s Persuasion and one in Margaret Oliphant’s The Doctor’s Family are examined from the point of view of trauma management with analysis of contributing risk factors, medical management, concerns of parents and bystanders, and course of recovery. Risk factors for injury are impulsivity, poor supervision, and parents who are unable to set limits. Medical attention is swift and competent, but no heroic measures are used; the management of the injuries, concussion with loss of consciousness and (...) dislocation of the collar bone, is consistent with the way these conditions are, for the most part, still managed today, and successful recovery depends on careful nursing and rest. Louisa Musgrove, who suffers a severe head injury, requires ten weeks of convalescence and undergoes a marked personality change, which we might today attribute in part to post-concussion syndrome but which may reflect contemporary debate about the biological basis of personality and behavior. A sudden traumatic injury to a child or adolescent changes the narrative abruptly, in fiction or in life, dividing a story into before and after, introducing grief and anxiety, and requiring that plans be rethought and personal relationships reshuffled with decisions about caretaking and nursing. In this paper, I look for the crip potential at the heart of cis. What would a theory of cisgender look like if that were presumed from the start? I begin by observing that many early endorsers theorizing cis were trans crip, mad, disabled people. In the first section, I grapple with the challenges that genealogy poses for cis as a construct. In the second section, I review disability studies and trans studies for a disability critique of cisness. I then (...) turn, in the third section, to expand Finn Enke’s critique of cis as a sane and able ontological category. Throughout, but especially in closing, I pivot (swerve, or spiral out) into the disabled, mad, crip experience of cisness as lived everyday rather than as theorized to date. I tarry with the disruptions and disorders thriving among those who nevertheless pass in close proximity to an always distant cis ideal. (shrink)

America’s moral educators have continually splintered our humanity throughout higher education’s history. Unable to agree upon a common ethical understanding of our humanity, educators turned to shards of our identity to help students find their moral bearings. The Dismantling of Moral Education explains why and how we arrived at this situation.

The norms of a legal system are relevant in deciding on people's rights and duties within that system. Some norms that are not part of a legal system are also relevant within it: norms of foreign legal systems, games, clubs, contracts, grammar, and so on. What distinguishes the norms of a legal system from the norms merely relevant within it? Where, in other words, are law's boundaries? There are three existing answers in the literature, from Kramer, Shapiro, and Raz. None (...) succeed. A better answer starts with a distinction between two types of legal relevance: direct and indirect. Norms of a legal system are directly relevant within it. Norms that are not part of a legal system are at most indirectly relevant within it. Thus, the two types of norms are distinguished by the directness of their relevance. (shrink)
